AstroTrellis, LLC ("AstroTrellis," "we," "us," "our") operates the Kairos Astrology web app and mobile application and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice.

These Terms incorporate our Privacy Policy by reference. Together, they form the entire agreement between you and AstroTrellis regarding your use of Kairos.

1. Eligibility

You must be at least 16 years old, wherever you live, to use Kairos. By creating an account, you confirm that you meet this age requirement. If we learn that someone under 16 has created an account, we will delete it and all associated data.

You may not access or use the Service if you are located in a country subject to U.S. government sanctions or if you are on any U.S. government restricted-parties list. By using Kairos, you represent that you are in compliance with all applicable export control and sanctions laws.

2. Description of Service

Kairos Astrology provides personalized astrological insights, AI-powered chart readings, transit and timing guidance, daily summaries, journaling features, and social features. The Service uses your birth data and conversations to generate chart interpretations rooted in the Jyotish tradition, and teaches you the astrology behind them.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account, whether or not you authorized it. You agree to:

We will not be liable for any loss arising from unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms. Your access privileges may not be transferred or assigned to any third party.

4. Subscriptions and Payments

4.1 Free and paid tiers. Kairos offers a free tier with limited features and a paid subscription that unlocks AI chat, additional question quotas, and other premium features.

4.2 Payment processing. Payments are processed by Stripe (for web purchases) or by Apple or Google (for in-app purchases through their respective app stores). We never receive or store your credit card details.

4.3 Free trial. Each account may start one free trial of paid features (currently 3 days) whenever you choose. When your trial ends, your account automatically reverts to the free tier with limited features. No payment is collected during the trial and no charge occurs when it expires. If you choose to subscribe during or after the trial, billing begins at that point.

4.4 Subscription terms. Paid subscriptions renew automatically at the end of each billing period unless you cancel before renewal. You can cancel at any time through your account settings (for Stripe) or through the App Store or Google Play (for in-app subscriptions).

4.5 Refunds. We do not offer refunds for digital products or services once accessed or used, or for subscription non-use or unused time, except where required by applicable law or the applicable purchase platform’s terms, or to correct verified billing errors, including duplicate charges. Canceling a subscription stops future renewals but does not automatically refund the current billing period.

Web purchases are processed through Stripe Managed Payments (“Sold through Link”) and are subject to Link’s refund policy, which takes precedence if our policy is more restrictive. Purchases through Apple or Google follow the respective store’s refund policies and procedures. Nothing in these Terms limits mandatory consumer rights. For assistance, contact [email protected].

4.6 Price changes. We may change subscription pricing with at least 30 days' notice. Price changes take effect at your next renewal. If you do not agree with a price change, cancel before the renewal date.

5. AI Features

5.1 How AI works in Kairos. Kairos uses artificial intelligence, including models AstroTrellis develops and models from third-party AI providers accessed through their business APIs, to interpret your birth chart, respond to your questions, and generate personalized astrological insights. The AI is not a human.

5.2 Model training. We use your AI conversations to evaluate and train our own models only if you turn on "Help make Bhrigu better" in Settings → Privacy, and only with your name, birth details and personal information removed. You can turn it off at any time. Your journal entries and birth data are not used to train our models, and none of your data is used to train any third party's models. Our AI providers' API terms prohibit them from using API traffic for model training. See "Improving Our Models" in our Privacy Policy.

5.3 Third-party information in AI chat. The AI generates astrological readings only for charts saved to your account or shared with you by another user through Kairos’s friend-sharing features, subject to that user’s privacy settings. Mentioning someone or providing their birth details in a conversation does not, by itself, make their chart available for a reading. Readings on sensitive topics are given only if you have turned on "Sensitive topics in readings", as described in our Privacy Policy. Your message (including any personal information it contains) is still transmitted to our AI providers as part of processing your request. You are responsible for having appropriate consent or a legitimate reason to share another person's information in chat.

5.4 AI limitations. AI-generated readings may contain inaccuracies or inconsistencies. They are interpretations, not facts. Do not rely on them for decisions that require professional expertise. See Section 7 (Disclaimer).

6. User Content

You retain ownership of any content you provide to Kairos, including your profile details (such as your name, photo, and biography), questions, journal entries, notes, and chat messages. By submitting content, you grant AstroTrellis a non-exclusive, worldwide, royalty-free license to use, store, display, and process that content for the purpose of providing and improving the Service, including showing your profile details to other users according to your privacy settings, as described in our Privacy Policy.

You are responsible for the content you submit. Do not submit content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.

Feedback. If you send us ideas, suggestions, or other feedback about the Service (whether by email, chat, or otherwise), you agree that we may freely use, copy, and modify that feedback without any obligation to you, including without compensation or attribution. This does not apply to personal data, which is governed by our Privacy Policy.

7. Astrological Guidance Disclaimer

The insights provided by Kairos are for informational, educational, and self-reflective purposes only. They do not constitute professional advice in the areas of health, medicine, psychology, finance, law, or any other regulated field. They are not diagnoses, prescriptions, or predictions of fixed outcomes.

Astrological readings describe patterns and potentials. You are responsible for your own decisions and actions. We encourage you to consult qualified professionals for matters requiring specialized expertise. AstroTrellis is not liable for any decision you make based on content generated by the Service. If you are in crisis or thinking about harming yourself, contact local emergency services.

8. Charts You Save for Other People

When you save a chart for someone else, you represent that you have a legitimate reason to hold their birth details (ordinarily because they are a family member or have agreed). You must not enter details for someone who has asked you not to.

Charts saved for other people are visible only to you and are never matched to another person's Kairos account. Readings covering sensitive topics (health or medical conditions, mental health conditions, sex life, sexual orientation, racial or ethnic origin, religious or philosophical beliefs, political opinions, trade-union membership) are given for charts you have saved for people aged 16 or over only if you have turned on "Sensitive topics in readings". They are never given for charts of people under 16. You may save a chart for someone under 16 only if you are 18 or over and their parent or legal guardian, and you confirm this when you save it. You may save up to four such charts. For those charts, temperament and tendency readings are permitted with additional safeguards, including a separate consent for timing readings. The full protections and limitations are described in our Privacy Policy.

9. Social Features

9.1 Friends and sharing. When you accept a friend request, that person may view your own chart and ask the AI about it, according to your privacy settings. This permission does not grant access to your chat history, journal entries, or charts you have saved for other people. A friend gets a reading on a sensitive topic from your chart only if you have turned on "Sensitive topics (AI)" in Advanced Privacy, the friend is allowed to ask the AI about your chart, and the friend has turned on their own "Sensitive topics in readings". You can revoke this permission for an individual or for everyone through your privacy settings.

9.2 Your responsibility. You control what is visible to others through your privacy settings. You are responsible for understanding your settings before accepting friend requests or sharing chart information. Content shared with other users cannot always be retrieved once sent.

10. Prohibited Conduct

You agree not to:

11. Reporting and Content Moderation

11.1 Reporting. If you believe another user is impersonating someone, harassing users, or otherwise violating these Terms, you can report them through the "Report profile" feature on their profile or by emailing [email protected].

11.2 Our response. We review reports and may take action including warning the user, restricting their account, or terminating it. We are not obligated to disclose the outcome of a report to the reporter, except as required by law.

11.3 EU users (Digital Services Act). If you are in the EU, you have the right to: (a) receive a statement of reasons if we restrict or remove your content or account, (b) appeal content moderation decisions through our internal complaint mechanism (email [email protected] with "Appeal" in the subject line), and (c) pursue out-of-court dispute resolution. We will respond to appeals within a reasonable time.

12. Intellectual Property

All content, design, algorithms, astrological recipes, methodologies, and proprietary frameworks within the Service are the intellectual property of AstroTrellis, LLC. You may not reproduce, reverse-engineer, decompile, distribute, or create derivative works from any part of the Service without our written permission.

The astrological methodology used in Kairos is based on the teachings of Ernst Wilhelm and is used under license. All rights to the underlying educational material remain with their original author.

You may link to Kairos only in a way that is fair and does not damage or exploit our reputation. You may not frame, mirror, or deep-link any part of the Service (including embedding our pages or content within another website or application) without our prior written permission.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER ASTROTRELLIS NOR ANY PERSON ASSOCIATED WITH ASTROTRELLIS MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASTROTRELLIS HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE.

WITHOUT LIMITING THE FOREGOING, ASTROTRELLIS DOES NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SERVICE WILL MEET YOUR NEEDS OR EXPECTATIONS.

Astrological readings are interpretations, not statements of fact. Any reliance you place on content generated by the Service is at your own risk.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Beta and experimental features. From time to time, we may offer features labeled as "beta," "preview," or "experimental." These features are provided on an "as is" basis, may be incomplete or contain errors, and may be modified or discontinued at any time without notice. YOUR USE OF BETA FEATURES IS AT YOUR OWN RISK, AND WE MAKE NO WARRANTIES OF ANY KIND REGARDING THEM.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASTROTRELLIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FROM RELIANCE ON ASTROLOGICAL READINGS, LOST DATA, LOSS OF PROFITS, OR SERVICE INTERRUPTIONS.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE FEES ACTUALLY PAID BY YOU IN THE TWO (2) MONTHS PRECEDING THE EVENT GIVING RISE TO YOUR CLAIM, OR ONE HUNDRED U.S. DOLLARS (US$100), WHICHEVER IS GREATER.

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, fraud, or gross negligence. Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, in which case our liability will be limited to the greatest extent permitted by law.

15. Indemnification

You agree to indemnify and hold harmless AstroTrellis, LLC, its members, and its contractors from and against any claims, losses, liabilities, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your violation of any third party's rights, or content you submit through the Service.

If you have a dispute with another user, you release AstroTrellis from claims arising out of that dispute.

California residents: By agreeing to these Terms, you waive California Civil Code § 1542, which provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

16. Account Deletion and Termination

16.1 By you. You may delete your account at any time from within the app (Settings > Delete Account) or by emailing [email protected]. We remove your personal data from active systems within 30 days of your deletion request. Deleted data may remain in encrypted backups for up to 30 additional days before being overwritten. Records required by law may be retained, records of feedback and reports you sent may be kept with your account identifier and username removed, and data that has been fully anonymized and can no longer identify you may be kept, as detailed in our Privacy Policy. Deleting your account does not automatically cancel an active subscription; cancel your subscription first.

16.2 By us. We may suspend or terminate your account for violation of these Terms, for suspected fraud or abuse, or if required by law. Where possible, we will provide notice before termination. In cases of serious violations (impersonation, harassment, security threats), we may terminate without prior notice.

16.3 Effect of termination. Upon termination, your right to use the Service ceases immediately. If we terminate your account, we handle your data as described in our Privacy Policy. Sections 6, 7, 12, 13, 14, 15, and 17 survive termination.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Yavapai County, Arizona.

Before filing a formal dispute, you agree to first contact us at [email protected] with a description of your claim. We will attempt to resolve the matter informally within 30 days. If we cannot reach a resolution, either party may proceed with formal legal action as described above.

If you are in the EU, EEA, UK, or Switzerland, nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence.

18. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the app or by email. The changes take effect when we notify you, or on a later date stated in the notice. If you continue to use the Service after that, the updated Terms apply to you. If you do not agree, you can stop using the Service and delete your account. A change to these Terms never turns on an optional setting for you; where a change needs your consent, we will ask for it.

19. Copyright Policy (DMCA)

We respect the intellectual property rights of others and expect users to do the same. If you believe that content available through the Service infringes your copyright, please send a written notice to [email protected] with the following information:

  1. A description of the copyrighted work you claim has been infringed
  2. A description of where the allegedly infringing material is located within the Service
  3. Your contact information (name, address, email, phone number)
  4. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
  6. Your physical or electronic signature

We will respond to valid DMCA notices in accordance with the Digital Millennium Copyright Act. We may remove or disable access to allegedly infringing content and, in appropriate circumstances, terminate the accounts of repeat infringers.

Counter-notification. If you believe your content was removed by mistake or misidentification, you may send a written counter-notification to [email protected] including: (1) identification of the material removed and its prior location, (2) a statement under penalty of perjury that you believe the removal was a mistake, (3) your name, address, and phone number, (4) a statement that you consent to the jurisdiction of the federal court in your district (or Yavapai County, Arizona if outside the U.S.) and will accept service of process from the person who filed the original notice, and (5) your physical or electronic signature. If we receive a valid counter-notification, we will forward it to the original complainant and restore the material within 10 to 14 business days unless the complainant notifies us of a court action. Filing a false counter-notification may result in liability for damages.

20. General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

No failure or delay by AstroTrellis in exercising any right or enforcing any provision of these Terms shall be considered a waiver of that right or provision, or a waiver of any subsequent breach.

AstroTrellis will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, labor disputes, government actions, power or internet outages, or failures of third-party services.

21. Third-Party Links

The Service may contain links to third-party websites or services that are not owned or controlled by AstroTrellis. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. You access them entirely at your own risk.

22. Notices

We may send you notices related to the Service via the email address associated with your account or through in-app notifications. You are responsible for keeping your contact information up to date. Notices from us are considered received when sent to your email on file or posted in the app. All legal notices to us must be sent to [email protected].

By using the Service, you consent to receiving service-related communications from us electronically (via email or in-app notifications). Marketing emails are sent only if you turn on "News and Updates" in Settings → Privacy, as described in our Privacy Policy. You agree that all agreements, notices, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

23. Accessibility

We are committed to making Kairos accessible to the widest possible audience. If you encounter accessibility issues or have feedback on how we can improve, please contact us at [email protected].

24. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Any attempted assignment or transfer without that consent is void. We may assign our rights and obligations under these Terms without your prior consent, including as part of a merger, acquisition, reorganization, or sale of assets. In that case, your information is handled as described under "Business transfers" in our Privacy Policy. These Terms bind and benefit the parties and their successors and permitted assigns.

25. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AstroTrellis, LLC regarding the use of Kairos Astrology. Nothing in these Terms creates any agency, partnership, joint venture, employment, or trust relationship between you and AstroTrellis. Except as expressly stated in these Terms, there are no third-party beneficiaries to this agreement. Section headings are for convenience only and have no legal effect.

26. California Residents

Under California Civil Code § 1789.3, California consumers are entitled to the following notice:
